Hawaii: Hawaii Consumer Privacy Act introduced in State House
House Bill ('HB') 2051 for the Hawaii Consumer Privacy Act was introduced, on 26 January 2022, in the Hawaii House of Representatives. In particular, HB 2051 would, among other things:
- set out requirements in relation to the reidentification of data;
- require businesses to provide consumers with a privacy notice outlining how consumer data is being used, processed, and shared;
- require written agreement when a business contracts with a service provider or third party;
- require businesses to maintain reasonable security measures;
- provide consumers with new rights such as the rights of access, correction, and to limit the processing of sensitive personal information; and
- provide the Director of the Hawaii Department of Commerce and Consumer Affairs with enforcement powers.
Furthermore, if enacted, HB 2051 would take effect on 1 January 2023.
Moreover, HB 2051 is distinct from two similar accompanying bills Senate Bill ('SB') 2428 for the Hawaii Consumer Data Protection Act and SB 2797 for the Hawaii Consumer Data Protection Act which were both introduced, on 21 January 2022, in the Hawaii State Senate.
